1. Provider and scope

These Terms apply to the Touchdown Tracker app, touchdown-tracker.com and related user accounts.

The terms of the relevant distribution platform, including the Apple Media Services Terms and Conditions, also apply. Mandatory law prevails in the event of a conflict.

2. Service

Touchdown Tracker is an independent digital stadium diary and American Football information service. Depending on the app version, users may:

  • discover teams, competitions, games and stadiums,
  • save favorite teams and games,
  • log visited games with ratings, notes, seat details and photos,
  • plan future stadium visits,
  • discover nearby games and use check-in assistance,
  • view personal and global statistics and leaderboards,
  • contribute profile and stadium images, and
  • receive optional push and weather alerts.

There is no entitlement to a particular function, item of content, league, game or stadium, or to uninterrupted availability. We may develop, change or discontinue the service while reasonably considering users’ legitimate interests.

3. Accounts and credentials

Some personal features require an account. Registration information must be accurate. Users must protect their username, password and device access against unauthorized use and notify us promptly if they suspect account misuse.

Each person should maintain only one regular account unless we expressly permit otherwise.

Minors may create an account only if they have any consent required from a parent or legal guardian and use of the service is lawful where they live.

4. Acceptable use

Touchdown Tracker may be used only lawfully and in accordance with these Terms. Users must not:

  • enter false visits, ratings or other data to manipulate statistics or leaderboards,
  • upload illegal, abusive, discriminatory, pornographic, glorifying-violence or otherwise unacceptable content,
  • infringe copyright, trademark, privacy, personality or other third-party rights,
  • introduce malware or circumvent security measures, interfaces or access restrictions,
  • scrape data at a scale not permitted through an interface approved by us,
  • share, sell or misuse accounts, tokens or credentials, or
  • interfere with the app, website or infrastructure.

5. User content

Users remain responsible for profile details, notes, ratings, seat information and uploaded photos and must hold all required rights.

For profile and visit photos, users grant us a non-exclusive, royalty-free, worldwide license, limited to the storage period, to technically store, process, reproduce and display the content within Touchdown Tracker according to the selected visibility. This license generally ends when the content or account is deleted, unless legal duties require otherwise.

We may review, restrict or remove content where there are specific indications of illegality, rights infringement, misuse or breach of these Terms. We do not generally review all user content before publication.

6. Stadium photos and CC0

Public stadium-photo submissions are accepted only under CC0 1.0. By submitting a photo, the user confirms that:

  • they created it or hold all required rights,
  • recognizable people and protected content are depicted lawfully,
  • to the extent legally possible, they release it worldwide and irrevocably under CC0, and
  • it may be used, copied, modified and distributed without payment, further permission or attribution.

Submissions are reviewed. There is no right to approval, publication, continued use or attribution. A valid CC0 release generally cannot be withdrawn even if we later remove the photo from Touchdown Tracker.

7. Public leaderboards

Leaderboards may publicly display usernames, optional first and last names, and aggregated numbers of visits, stadiums, countries and seasons. Profile photos are displayed there only if their visibility is set to “public”. Users must not use another person’s name or image as their own profile information without permission.

8. Data, schedules and check-ins

Game, score, team, stadium, distance and weather data may come from third-party sources, may be delayed and may contain errors. It is provided for information and planning, not as a binding promise. Users must check the organizer’s official information regarding travel, admission, kickoff, cancellations, stadium rules, safety and accessibility.

A Touchdown Tracker check-in is not a ticket, proof of admission or official attendance record.

9. Voluntary tips and payments

Voluntary in-app tips are one-time support payments and do not unlock features, content or subscriptions. Apple processes in-app purchases. Prices, taxes, billing, cancellation and refunds are governed by applicable law and Apple’s terms.

Voluntary website support payments may be processed by PayPal or Stripe, whose terms also apply. No tax-deductible donation receipt is issued.

10. Our rights and third-party rights

The app, website, design, software and our own content are legally protected. Reproduction, modification, distribution or public display outside the intended use requires permission.

Touchdown Tracker is independent and is not affiliated with, authorized, sponsored or endorsed by the NFL, NCAA, German Football League, Canadian Football League, United Football League, Liga de Fútbol Americano Profesional, European League of Football, European Football Alliance, Austrian Football League, Austrian College Sports League, AFLE, International Alliance League, X-League Japan or their respective teams. League, team and product names, logos and trademarks belong to their respective rights holders and are used solely for editorial and informational purposes.

11. Suspension, termination and deletion

Users may end their account at any time in the app under Menu → Delete account. See the Privacy Policy for details of data deletion.

We may remove content, restrict functions or temporarily suspend an account where there are specific indications of a breach. We may terminate and delete an account for serious or repeated breaches, risks to IT security or where required by law. Where appropriate, we will notify the user first and allow them to respond.

12. Availability and changes

We aim to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, security measures, technical disruptions or changes to external data sources and platforms may temporarily limit functions.

Material changes to these Terms will be announced appropriately, for example in the app, on the website or by email. We will request consent where required by law.

13. Liability

We are fully liable for intent and gross negligence, injury to life, body or health, liability under mandatory product-liability law and within the scope of an expressly assumed guarantee.

For ordinary negligence affecting an essential contractual duty, liability is limited to foreseeable damage typical for the contract. Essential duties are those whose performance makes proper execution of the contract possible and on which users may regularly rely. Liability for other ordinary negligence is excluded to the extent permitted by law.

Users are responsible for reasonable backups of their devices and locally stored data. These limitations also apply for the benefit of our legal representatives and agents.

14. Privacy

Information about personal-data processing is available in the Privacy Policy.

15. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protections of the country in which a consumer habitually resides remain unaffected.

An exclusive place of jurisdiction applies only where legally permitted, particularly for merchants, legal entities under public law or special public-law funds.

If a provision is invalid, the remaining provisions remain effective and the applicable statutory rule replaces the invalid provision.
